TDS Return Filing
Tax Deducted at Source (TDS) is a mechanism under the Income-tax Act, 1961 wherein tax is deducted at prescribed rates at the time of specified payments. The deductor is required to deposit the tax with the government and file periodic TDS returns.
Key Compliance Requirements under TDS
• Timely deduction of tax at applicable rates
• Deposit of TDS within prescribed timelines (generally by 7th of next month)
• Filing of quarterly TDS returns
• Issuance of TDS certificates (Form 16 / 16A)
• Proper reporting of PAN and transaction details
Interest and Penalty Provisions
• Interest @ 1% per month – for non-deduction of TDS
• Interest @ 1.5% per month – for delay in deposit
• Late filing fee under Section 234E – ₹200 per day (subject to TDS amount)
• Penalty under Section 271H – ₹10,000 to ₹1,00,000 (in specified cases)
Due dates for TDS payment & return filing
Payment of TDS deducted under various sections of the income tax act: Before 7th day of Next Month except March month TDS which can be paid upto 30th day of April.
1st Quarter TDS Return (1st April to 30th June): Quarterly on or before 31st July
2nd Quarter TDS Return(1st July to 30th September): Quarterly on or before 31st Oct
3rd Quarter TDS Return(1st October to 31st December): Quarterly on or before 31st Jan
4th Quarter TDS Return(1st January to 31st March): Quarterly on or before 31st May
